Part A: Client Terms

Version 1.0, published 9 October 2026. These terms apply to every service Fusion Agency supplies to a business client.

1. Who we are and when these terms apply

  1. "Fusion", "we" and "us" means LH International Ltd, trading as Fusion Agency, a company registered in England and Wales (company number 13441384, registered office 18 Albatross Way, Basingstoke, RG23 7SN).
  2. "You" means the business named on our invoice or quote. You confirm you are buying for business purposes, not as a consumer.
  3. A contract is formed when you pay our invoice or accept our quote in writing, whichever comes first. These terms, Part B (Data Processing Agreement) and the invoice or quote together form the whole agreement.
  4. If the invoice or quote conflicts with these terms, the invoice or quote wins. If anything conflicts with Part B on data protection, Part B wins.

2. Our services

  1. Free Website Audit: a free summary of your website's AI and search visibility. No payment and no obligation to buy.
  2. Advanced GEO Audit: a paid audit of your visibility in AI assistants and Google against up to 3 competitors, delivered as a PDF report and an editable PowerPoint, with one walk-through call.
  3. Custom project: fixed-price work to fix the issues an audit finds, as set out in our quote.
  4. AI Visibility Monitor: a monthly subscription for a monthly visibility report, drop alerts and a quarterly re-score.
  5. We will carry out all services with reasonable skill and care, in line with good industry practice.

3. Prices and payment

  1. Prices are in pounds sterling, as shown on the invoice or quote. We are not currently registered for VAT, so no VAT is charged. If we register, we will tell you in advance and add VAT at the applicable rate from our registration date.
  2. All services are paid in advance. You can pay by card through the secure payment link on the invoice, or by bank transfer. Work starts once payment clears.
  3. If an amount is overdue, we may charge interest and fixed compensation under the Late Payment of Commercial Debts (Interest) Act 1998, and pause any service until it is paid.

4. Advanced GEO Audit

  1. We deliver your report within 10 working days of receiving both your payment and your completed intake form.
  2. The fee covers the audit, the report and one walk-through call of up to 45 minutes.
  3. Once we have started the audit, the fee is not refundable. If we have not delivered the report within 20 working days of receiving your payment and intake form, and the delay is not caused by you, you may cancel for a full refund.

5. Custom projects

  1. Each quote sets out the work, the fixed price and the estimated timescale. Quotes are valid for 14 days.
  2. The full price is paid when you order. Work you ask for outside the quote is quoted separately before we start it.
  3. Timescales are estimates and depend on you giving us access and approvals on time (clause 7).
  4. We may use vetted specialist subcontractors. We stay fully responsible for their work, and each one is bound by confidentiality and data protection terms at least as strict as these.
  5. We re-check your scores 30 days after the project is completed and share the results with you.

6. AI Visibility Monitor

  1. The Monitor is billed monthly in advance and renews automatically each month. You authorise us to charge your saved card on each renewal date.
  2. There is no minimum term. You can cancel at any time by emailing sales@thefusionagency.com, giving 30 days' notice. Cancellation takes effect at the end of the billing month in which the 30 days end.
  3. We do not refund part months.
  4. If a payment fails and is still unpaid 7 days later, we may pause the Monitor until it is paid.
  5. We may change the monthly price by giving you at least 30 days' notice by email. You can cancel before the change takes effect.

7. What we need from you

  1. Accurate information about your business, services and competitors, and a completed intake form.
  2. Read-only access to tools such as Google Analytics or Google Search Console where a service needs it.
  3. Feedback and approvals within 5 working days of a request. Delays on your side extend our timescales by the same amount.
  4. You remain responsible for your website, for any content you approve or publish, and for the accuracy and legality of claims about your business.
  5. You confirm you have the right to share with us any data or materials you provide.

8. No guaranteed results

  1. AI assistants and search engines are run by third parties, and they change how they work without notice. We do not guarantee any ranking, mention, recommendation, number of visitors, enquiries or sales.
  2. Figures in our reports for missed visitors, enquiries or sales are estimates to help you make decisions. They are not promises.

9. Intellectual property

  1. You keep ownership of your materials, brand and data.
  2. Once you have paid in full, you own the content we write specifically for you in a custom project, and you may use your reports freely within your business.
  3. Fusion keeps ownership of its methods, software, audit tools, templates, question panels and know-how, including any improvements made while working for you. Nothing in these terms transfers them to you.
  4. We will only name you or publish a case study about your business with your written permission.

10. Confidentiality

  1. Each of us will keep the other's confidential information private and use it only to perform this agreement.
  2. This does not apply to information that is public through no fault of the receiving party, or that the law requires to be disclosed.
  3. This clause continues for 2 years after the agreement ends.

11. Liability

  1. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow to be limited.
  2. Neither of us is liable for loss of profit, revenue, business, contracts or goodwill, or for any indirect or consequential loss.
  3. Our total liability under or in connection with each contract is limited to the fees you paid us under it in the 12 months before the claim arose.

12. Ending the agreement

  1. Either of us may end the agreement immediately by written notice if the other seriously breaches it and does not put it right within 14 days of being asked to, or becomes insolvent.
  2. When the agreement ends, any amounts already due remain payable, and clauses 8 to 11 and 13 to 14 continue to apply.

13. Data protection

  1. Each of us will comply with UK data protection law, including the UK GDPR and the Data Protection Act 2018.
  2. Where we process personal data on your behalf, Part B (Data Processing Agreement) applies and forms part of these terms.
  3. Where we use personal data for our own purposes, such as managing your account and invoicing, our Privacy Notice in Part C applies.

14. General

  1. Non-solicitation: during the agreement and for 12 months after it ends, you will not directly engage any contractor who worked on your account through us, without our written consent.
  2. Delays outside our control: neither of us is liable for delay caused by events beyond our reasonable control.
  3. Changes to these terms: we may update these terms. The version published on the date you pay applies to that order, and to Monitor renewals after we have given you 30 days' notice of a change.
  4. Notices: notices are sent by email, to sales@thefusionagency.com for us and to the billing email on our invoice for you.
  5. Transfer: neither of us may transfer the agreement without the other's written consent, except that we may transfer it to another company in our group or to a buyer of our business.
  6. Third parties: no one other than you and us has rights under this agreement.
  7. Severance: if any part of these terms is found unenforceable, the rest stays in force.
  8. Law: these terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.

Part B: Data Processing Agreement

This agreement meets Article 28 of the UK GDPR. It applies whenever Fusion processes personal data on your behalf while providing the services in Part A.

1. Roles

  1. You are the controller and Fusion is the processor of the personal data described in clause 2.
  2. Fusion is a controller only for its own account, billing and marketing records, which are covered by its privacy notice.
  3. Stripe processes card payments as an independent controller under its own terms.

2. What we process

Subject matter: providing the Advanced GEO Audit, custom projects and the AI Visibility Monitor.

Duration: for as long as we provide services to you, plus the return and deletion period in clause 8.

Nature and purpose: analysing your website, analytics and search data; producing reports; making agreed changes to your website and tracking.

Types of personal data: names, job titles and business contact details shown on your website or in your tools; website visitor data in your analytics, such as IP-derived location, device and pages viewed; enquiry form submissions where a project involves tracking set-up.

Data subjects: your staff, your website visitors, and people who submit enquiries through your website.

Special category data: none. You will not give us access to special category or criminal offence data.

3. Our obligations

  1. Instructions: we process personal data only on your documented instructions, which are these terms and your written requests, unless the law requires otherwise. We will tell you if we think an instruction breaks data protection law.
  2. Confidentiality: everyone who processes the data for us is bound by a duty of confidentiality.
  3. Security: we apply the measures in clause 6.
  4. Help with rights requests: we will help you respond to people exercising their data protection rights, and pass on any request we receive about your data within 5 working days.
  5. Help with compliance: we will give you reasonable help with security, breach notifications, data protection impact assessments and consultation with the Information Commissioner's Office.
  6. Records: we keep a record of processing carried out for you.

4. Sub-processors

  1. You give general authorisation for us to use the sub-processors below. Each is bound by a written contract with data protection terms at least as strict as this agreement, and we remain responsible for them.
  2. We will tell you by email at least 30 days before adding or replacing a sub-processor. If you object on reasonable data protection grounds, you may end the affected service and receive a refund of any prepaid fees for the unused period.

Our current sub-processors are:

  • Anthropic (Claude): runs the audit analysis and drafts reports.
  • HubSpot: CRM, website forms and email delivery.
  • Semrush: search and AI visibility data.
  • Google Workspace: email and document storage.
  • Zoho Books: invoicing and billing records.
  • LH Group companies: shared staff and systems that support Fusion's operations.
  • Vetted specialist contractors: custom project delivery, named in each quote.

5. Transfers outside the UK

  1. We transfer personal data outside the UK only where UK law allows it: to a country with UK adequacy regulations, to a US organisation certified under the UK Extension to the EU-US Data Privacy Framework, or under the ICO's International Data Transfer Agreement or the UK Addendum to the EU Standard Contractual Clauses.
  2. Contractors outside the UK sign the International Data Transfer Agreement before they receive any personal data.

6. Security measures

  • Multi-factor authentication on every system that holds client data.
  • Access limited to the people working on your account, and removed when the work ends.
  • Read-only access to your analytics and search tools wherever possible.
  • Data encrypted in transit and at rest through our providers.
  • Contractors work inside Fusion's systems where possible and delete local copies at the end of each project.
  • No personal data used to train AI models, and AI tools used only under business terms that exclude training on our data.

7. Personal data breaches

  1. We will tell you without undue delay, and within 48 hours of becoming aware of a breach affecting your personal data.
  2. Our notice will describe what happened, the data and people likely affected, the likely consequences, and what we are doing about it, so you can meet your own 72-hour duty to report to the ICO where it applies.

8. When the services end

  1. Within 30 days of the services ending, we will delete or return your personal data, at your choice, and delete remaining copies, unless the law requires us to keep it.
  2. Reports we have already delivered to you are yours to keep.

9. Audits

  1. On request, we will provide the information you reasonably need to show we comply with this agreement.
  2. You may audit our compliance, yourself or through an independent auditor bound by confidentiality, once a year on 30 days' written notice, at your own cost.

10. Liability

Each party's liability under this agreement is subject to the limits in Part A, clause 11, except where the law does not allow it to be limited.

Part C: Privacy Notice

Version 1.0, published 9 October 2026. This notice explains how LH International Ltd, trading as Fusion Agency, uses personal data about you when you visit our website, ask for a free audit, become a client or work with us.

1. Who we are

  1. The controller is LH International Ltd, trading as Fusion Agency, a company registered in England and Wales (company number 13441384), registered office 18 Albatross Way, Basingstoke, RG23 7SN.

2. What we collect, why, and our lawful basis

People who request a free audit

  • What we collect: name, business email, company, website address, and phone number if given.
  • Where it comes from: you, through our website form.
  • Why we use it: to produce and send your free audit, and follow up about the Advanced GEO Audit.
  • Lawful basis: steps you asked us to take before a contract; legitimate interests for the follow-up.

Subscribers to our emails

  • What we collect: name and email address.
  • Where it comes from: you, when you tick the marketing box.
  • Why we use it: to send AI visibility tips and offers.
  • Lawful basis: consent, which you can withdraw at any time.

Business prospects

  • What we collect: name, job title, business email and phone, and company details.
  • Where it comes from: LinkedIn, company websites, Companies House and business directories.
  • Why we use it: to contact businesses that may benefit from our services.
  • Lawful basis: legitimate interests in promoting our services to other businesses.

Clients and their staff

  • What we collect: contact details, billing details, payment records, emails and meeting notes.
  • Where it comes from: you and your colleagues.
  • Why we use it: to deliver our services, invoice you and keep accounting records.
  • Lawful basis: contract; legal obligation for tax and accounting records.

Website visitors

  • What we collect: IP address, device, browser, pages viewed and cookie identifiers.
  • Where it comes from: your device, through cookies.
  • Why we use it: to run the website securely and, with your consent, measure how it is used.
  • Lawful basis: legitimate interests for essential cookies; consent for analytics and marketing cookies.

Contractors, suppliers and referral partners

  • What we collect: contact, bank and payment details, and agreement records.
  • Where it comes from: you.
  • Why we use it: to manage our working relationship and pay you.
  • Lawful basis: contract; legal obligation.

Card payments are processed by Stripe. We never see or store your full card number.

Prospects: if we contact you about our services, we tell you where we got your details in our first message, and you can object at any time. We will then stop contacting you.

3. How we use AI

We use AI tools, including Claude, to analyse public website data and draft reports. A person at Fusion reviews every report before it is sent. We do not make any decision about you based solely on automated processing that has a legal or similarly significant effect on you, and our AI tools are used under business terms that do not allow your data to be used to train their models.

4. Who we share it with

  • Service providers who run our business systems: HubSpot (website, CRM and email), Google Analytics (website measurement), Zoho (invoicing), Stripe (payments), Google Workspace (email and files), Anthropic (AI analysis), Semrush (search data) and LinkedIn (outreach).
  • Other companies in the LH Group, which provide shared staff and systems, under a written intra-group agreement.
  • Vetted specialist contractors who deliver client projects, under written agreements.
  • Our accountant, solicitors and other professional advisers.
  • HMRC, regulators and law enforcement, where the law requires it.
  • A buyer or investor in our business, under confidentiality, if all or part of the business is sold or invested in.

We never sell your personal data.

5. Transfers outside the UK

Some of our providers process data outside the UK, mainly in the USA and the European Union. Where they do, we rely on UK adequacy regulations, the UK Extension to the EU-US Data Privacy Framework, or the ICO's International Data Transfer Agreement or UK Addendum. Email us for a copy of the safeguards that apply.

6. How long we keep it

  • Free audit requests that do not become clients: 2 years from our last contact.
  • Business prospects who do not reply: 12 months from first contact.
  • Client records, invoices and payment records: 6 years after the end of the financial year they relate to.
  • Marketing email consent: until you unsubscribe. Your email is then kept on a suppression list so we do not contact you again.
  • Website analytics: up to 26 months.
  • Contractor and supplier records: 6 years after the relationship ends.

7. Your rights

You have the right to:

  • ask for a copy of your personal data;
  • have inaccurate data corrected;
  • have your data deleted, or its use restricted, in some circumstances;
  • object to our use based on legitimate interests, and to stop direct marketing at any time;
  • receive your data in a portable format, in some circumstances;
  • withdraw consent at any time, without affecting what we did before.

To use any of these rights, email sales@thefusionagency.com. We will reply within one month and will not charge a fee in most cases.

8. Cookies

Our website uses cookies. Essential cookies keep it working and secure. Analytics and marketing cookies, from HubSpot and Google Analytics, are only set if you accept them in our cookie banner. You can change your choice at any time through the cookie settings link at the bottom of every page.

9. Complaints

Please contact us first so we can put things right. You also have the right to complain to the Information Commissioner's Office at ico.org.uk or on 0303 123 1113.

10. Changes to this notice

We will publish any update on this page with a new version number and date.
